Abstract: | El presente trabajo tiene por objeto analizar, a la luz de la reciente doctrina administrativa y jurisprudencial, la cuestión relativa a la tributación de la hipoteca unilateral en el Impuesto de Transmisiones Patrimoniales y Actos Jurídicos Documentados (ITP y AJD). Se analiza en particular el alcance de la reciente jurisprudencia del Tribunal Supremo, en virtud de la cual, salvo que la constitución de la hipoteca unilateral se haga sin el conocimiento y consentimiento de la Administración tributaria, a resultas de la constitución de la hipoteca unilateral a favor de la Hacienda Pública se producirá la sujeción con exención para la Administración tributaria, quien tendrá siempre la condición de sujeto pasivo del gravamen gradual. Al margen de la concurrencia del interés legítimo consistente en obtener una suspensión, un aplazamiento o fraccionamiento de la deuda tributaria, el consentimiento previamente comprometido por la Administración otorgará a ésta su condición de sujeto pasivo con el disfrute de la referida exención. The purpose of this paper is to analyze, in the light of the recent administrative and jurisprudential doctrine, the question regarding the taxation of the unilateral mortgage in the ITP y AJD. In particular, the scope of the recent jurisprudence of the Supreme Court is analyzed, by virtue of which, unless the constitution of the unilateral mortgage is made without the knowledge and consent of the Tax Administration, as a result of the constitution of the unilateral mortgage in favor of the Public Treasury, this will be subject to exemption for the tax administration, who will always have the status of taxpayer of the gradual tax. Regardless of the concurrence of the legitimate interest consisting in obtaining a suspension, a postponement or fractionation of the tax debt, the consent previously committed by the Administration shall grant the latter its status as a taxpayer with the benefit of said exemption. |
