Abstract: | En términos normativos en Portugal el poder judicial tiene un papel más dignificado y con más garantías constitucionales e institucionales que en España. En primer lugar, la tarea más noble que un tribunal puede tener, es la de conferir la constitucionalidad de las leyes entregadas a los tribunales portugueses –aunque descrita en la forma mitigada– pero es excluida de los tribunales españoles. En segundo lugar, el autogobierno de los jueces portugueses es fuerte e independiente, en cuanto en el caso de los jueces españoles se verifica una completa dependencia del poder político, lo que amenaza la real independencia de las magistraturas. In terms of policy, Portugal has a greater deal of dignity, constitutionality, and institutionalism in its judicial power than Spain. Firstly, a highly noble act by a jury is to confer constitutionality of law to Portuguese courts –though described in a mitigated way– and yet this act is left out in the Spanish justice system. Secondly, judges in Portugal have self-government, which makes their ruling strong and independent, whereas Spanish judges entirely depend on political power, which threatens the true independence of magistrates. |
