Crisis del actual concepto de vivienda. Análisis de los derechos en conflicto y observación de algunas respuestas ofrecidas por el ordenamiento jurídico vigente

Abstract

El presente artículo trata el proceso de modificación del concepto de vivienda y su mercado debido a la necesidad de dar respuesta a nuevos comportamientos sociales desde la perspectiva jurídica de tres derechos implicados: Derecho de Propiedad Privada, el ejercicio del Derecho de Libertad de Empresa y finalmente, la evolución del Derecho de Acceso a una Vivienda Adecuada, propuesta por las actuales regulaciones. Este texto analiza el concepto de vivienda dinámico, en el juego de los tres factores considerados: Derechos de Propiedad, Libre Empresa y Derecho de Acceso a una Vivienda Adecuada, en una propuesta en la que el péndulo pudiera estar dirigiéndose en sentido contrario a lo que históricamente se ha reconocido como tal, en el cambio hacia una vida nómada. Esta vez se trataría de un movimiento migratorio de carácter individual, en lugar de oleadas compuestas por población proveniente de un concreto lugar hacia un destino común. Acertada o no, la premisa, como cambio absoluto de paradigma, lo cierto es que la vocación de permanencia en un lugar para convertirlo en asentamiento permanente, al que llamar hogar y desarrollar en él toda una vida, generación tras generación, hacerlo propio y transmitirlo a los descendientes, está en cuestión en la sociedad y la economía actual y el Derecho debiera dar una respuesta satisfactoria a estas nuevas necesidades.

This article deals with the process of modification of the concept of housing and its market due to the need to respond to new social behaviors from the legal perspective of three rights involved: the Right to Private Property, the exercise of the Right to Freedom of Enterprise and finally, the evolution of the Right of Access to Adequate Housing. proposed by the current regulations. This text analyzes the concept of dynamic housing, in the play of the three factors considered: Property Rights, Free Enterprise and Right of Access to Adequate Housing, in a proposal in which the pendulum could be swinging in the opposite direction to what has historically been recognized as such, in the change towards a nomadic life. This time it would be an individual migratory movement, rather than waves made up of people coming from a specific place to a common destination. Whether or not the premise is correct, as an absolute change of paradigm, the truth is that the vocation to remain in a place to turn it into a permanent settlement, to call home and develop a whole life in it, generation after generation, to make it one's own and transmit it to descendants, is in question in today's society and economy and the Law should provide a satisfactory response to these new needs.
